Sexual Harassment Prevention Training FAQ
What/Who is this course for?
This course fulfills the requirement for Sexual Harassment Prevention Training as required by the State of Illinois when the Workplace Transparency Act was signed into law August 2019. Any company conducting business in the state is required to provide this training for employees. It also qualifies as 1 Hour of Ethics CE credit for Illinois Insurance Producers.
What is the penalty for not providing this course?
Failure to provide training will consist of:
- A notice from the State to show cause giving the employer 30 days to comply after which the employer faces potential fines
- Companies with fewer than 4 employees will face up to a $500 fine for a 1st offense, up to a $1000 fine for a 2nd offense, and up to a $3000 fine for a 3rd offense and subsequent offenses.
- Companies with 4 or more employees will face up to a $1000 fine for a 1st offense, up to a $3000 fine for a 2nd offense, and up to a $5000 fine for a 3rd offense and subsequent offenses.
When must the initial training be done?
Employers have until December 31, 2021 to comply or face the aforementioned penalties.
How often is this training required?
Training must be provided on an annual basis. (Insurance producers can only receive 1 Ethics CE credit during the same renewal cycle)
Will a record of attendance be sent to the State?
Insurance Producers will have their Ethics CE credit hour reported to the Department of Insurance. Upon completion all students will receive a certificate that should be kept in the records of the employer. The State will not have a system to report completion, but can request to inspect an employers records to verify compliance.
